Rubbish Clearance Bow Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Bow provides rubbish removal, waste collection and related services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below.

Customer means the person, business or organisation requesting the services of Rubbish Clearance Bow.

We, us, our means Rubbish Clearance Bow, the waste collection service provider.

Services means any rubbish clearance, waste removal, loading, transport, disposal, recycling or related work that we agree to undertake.

Waste means any items, materials, goods, substances, junk, furnishings, debris or refuse to be removed by us as part of the Services.

Site means the property, premises or location from which the Waste is to be collected or where the Services are to be performed.

2. Scope of Services

We provide on-demand and scheduled rubbish clearance and waste collection services for household, garden, office and light construction waste, subject to applicable waste regulations and these Terms and Conditions. We reserve the right to refuse to collect any items or materials that we reasonably believe are hazardous, prohibited, illegal, too heavy or unsafe to handle, or outside the scope of the agreed Services.

We are not a skip hire company and do not provide long-term container hire. All Waste is normally removed on the same visit, unless otherwise agreed in writing. Any description of the Services given in verbal or written quotations is for guidance only and does not limit our right to vary our methods of work, provided that the overall nature of the Services remains substantially the same.

3. Booking Process

3.1 Bookings can be made by telephone, email or any other method we make available. When making a booking, the Customer must provide accurate information about the type, approximate volume or weight of Waste, access to the Site, parking arrangements and any other relevant details.

3.2 Any estimated price provided prior to attending the Site is based on the information supplied by the Customer. If, upon attendance, the actual nature or quantity of Waste, or access conditions, differ from what was described, we reserve the right to revise the quotation before commencing work.

3.3 A booking is only confirmed when we have accepted it and provided the Customer with a date and, where possible, an estimated time window for attendance. All attendance times are approximate and subject to traffic, weather conditions and operational factors. We will use reasonable endeavours to attend within the stated time window but cannot guarantee exact arrival times.

3.4 The Customer, or an authorised representative aged 18 or over, must be present at the Site at the time of collection to confirm the Waste to be removed, agree final pricing and provide access. If no one is present, we may at our discretion attempt to proceed with the collection based on prior instructions, or treat the booking as cancelled, which may incur a charge.

4. Quotations and Pricing

4.1 Quotations may be given based on volume, weight, type of Waste, labour required and access to the Site. All quotes are exclusive of any parking charges, tolls, fines or additional costs incurred due to restricted access, which may be added to the final invoice.

4.2 Unless expressly stated otherwise, all prices are given in pounds sterling and are exclusive of VAT. If VAT is payable, it will be added at the prevailing rate.

4.3 Any quotation is an estimate only and is subject to change once our operatives have inspected the Waste on Site. Before commencing work, we will confirm the final price. If the Customer does not agree to the revised price, we will not be obliged to carry out the Services and reserve the right to charge a call-out or cancellation fee as set out in these Terms and Conditions.

5. Payments

5.1 Payment is due in full on completion of the Services, unless we have agreed alternative terms in writing prior to the booking. For commercial Customers, we may, at our discretion, agree credit terms, subject to satisfactory references and ongoing compliance with our payment requirements.

5.2 We accept payment by cash, debit or credit card and any other methods we may offer from time to time. Where payment is made by card, the Customer authorises us to take payment for the agreed amount using the card details provided.

5.3 If the Customer fails to make payment when due, we reserve the right to charge interest on any outstanding sums at the rate of 8 percent per annum above the Bank of England base rate, calculated daily until payment is made in full. We may also charge reasonable administrative and recovery costs, and may withhold further services until all outstanding amounts have been settled.

5.4 In the event of non-payment, we reserve the right to recover any costs associated with the collection of overdue amounts, including legal fees and debt collection charges, from the Customer.

6. Cancellations, Amendments and Access

6.1 The Customer may cancel or amend a booking by giving us reasonable notice. Cancellations or significant changes made less than 24 hours before the scheduled attendance time may, at our discretion, be subject to a cancellation charge to cover our administrative and operational costs.

6.2 If our operatives attend the Site at the agreed time and are unable to carry out the Services due to the Customer's failure to provide access, ensure attendance of an authorised person, or accurately describe the Waste, we may treat this as a same-day cancellation and charge a call-out fee.

6.3 Where access to the Site is restricted, the Customer must notify us when making the booking and take reasonable steps to secure parking or permits where required. Any additional time incurred due to poor access, lack of parking or Site obstructions may be charged as extra labour at our prevailing rates.

6.4 We may cancel or postpone the Services at any time if we consider that it would be unsafe, unlawful, or otherwise inappropriate to proceed, including in cases of severe weather, accidents, vehicle breakdown or where the Waste is found to be hazardous or prohibited. In such cases, we will seek to reschedule the booking as soon as reasonably practicable.

7. Customer Responsibilities

7.1 The Customer is responsible for ensuring that the Waste to be collected is clearly identified and segregated where necessary. The Customer must not include hazardous or prohibited materials unless we have explicitly agreed in writing to handle such materials in compliance with all regulatory requirements.

7.2 The Customer must ensure safe and reasonable access to the Site, including clear pathways, adequate lighting, and, where necessary, the lifting or securing of any access restrictions such as gates or security barriers. The Customer must notify us of any known risks or hazards at the Site.

7.3 Where any Waste contains personal data or confidential material, the Customer is responsible for ensuring appropriate destruction or removal of such information. We do not undertake data destruction services unless expressly agreed in writing and accept no liability for any data left within the Waste.

7.4 The Customer warrants that they either own the Waste or have the full authority of the owner to arrange its removal. The Customer will indemnify us against any claim made by a third party arising from our removal of the Waste on the Customer's instructions.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with applicable UK waste management legislation and regulations, including requirements relating to the storage, transport and disposal of controlled waste. We will use authorised waste transfer and disposal facilities and will seek to reuse or recycle Waste where reasonably practicable.

8.2 We reserve the right to refuse to collect any materials that are classed as hazardous, toxic, explosive, highly flammable, medical, clinical or otherwise regulated, including but not limited to asbestos, chemicals, solvents, oils, pressurised containers, gas bottles, ammunition, biological waste and radioactive materials.

8.3 Where we agree to collect any Waste that may be subject to special handling or regulatory controls, the Customer must provide full and accurate information about the nature and composition of such Waste. Any additional costs incurred in complying with relevant regulations, including specialist containers, protective equipment or disposal charges, will be payable by the Customer.

8.4 On request and where required, we will provide a waste transfer note or equivalent documentation as evidence that Waste has been transferred to an authorised facility. The Customer is responsible for retaining such documentation for any period required by law.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill when providing the Services. However, we shall not be liable for any loss or damage arising from inaccurate information provided by the Customer or from failure to comply with these Terms and Conditions.

9.2 The Customer must take reasonable steps to protect property at the Site, including floors, walls, fixtures and fittings, particularly where large or heavy items are to be removed. While we will use reasonable care to avoid damage, minor scuffs or marks may occur during the removal of bulky items. We are not liable for normal wear and tear or for pre-existing damage.

9.3 Our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable for the specific Services giving rise to the claim, except where such limitation is prohibited by law.

9.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under UK law.

9.5 We shall not be liable for any indirect or consequential loss, loss of profits, business interruption, loss of data, loss of goodwill or any similar damage suffered by the Customer or any third party, even if such loss was foreseeable.

10. Insurance

We maintain public liability insurance and, where applicable, employer's liability insurance at levels appropriate to the nature of our business. Details of our insurance cover can be made available to the Customer on request. It remains the Customer's responsibility to ensure that they have adequate insurance in place for their own property and interests.

11. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they must notify us as soon as possible, and in any event within 7 days of completion of the Services. We will investigate complaints promptly and seek a fair resolution, which may include rectification of the issue, a partial refund or another appropriate remedy, at our discretion.

In the event that a dispute cannot be resolved directly between us and the Customer, either party may consider seeking advice from an independent adviser or, where appropriate, using alternative dispute resolution processes. These Terms and Conditions do not affect any statutory rights the Customer may have under consumer protection legislation.

12. Data Protection and Privacy

We will collect and process personal information about Customers only as necessary to manage bookings, provide Services, process payments and communicate about our services. We will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such information secure.

We may retain Customer details for administrative, legal and accounting purposes for as long as is reasonably necessary. Customers may request access to, or correction of, their personal data held by us, subject to legal limitations and our need to retain certain records.

13. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure results from events or circumstances beyond our reasonable control. These may include, but are not limited to, extreme weather, acts of God, war, terrorism, civil unrest, strikes, industrial disputes, breakdown of plant or machinery, power failure, or restrictions imposed by authorities.

14. Variation of Terms

We reserve the right to amend or update these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to Customers and will apply to all bookings made on or after that date. The version of the Terms and Conditions in force at the time of booking will govern the relevant Services.

15. Severability

If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, formation or termination, whether contractual or non-contractual.

By making a booking with Rubbish Clearance Bow or allowing our operatives to commence work, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
